1. Faits

1. Facts

The employee (A.) was hired in June 2022 by the social services department of the City of Geneva as a social welfare attendant at a civil protection shelter for homeless persons, under a seven-month fixed-term contract (CDD). The contract was renewed four times, the last extension running until 30 April 2026, for a total duration of three years and eleven months. In 2025, the employee received a written warning for failure to observe scheduled working hours, inaccurate manual time entries, and an allegation of having slept during a night shift. He did not challenge the warning before the Administrative Chamber of the Geneva Court of Justice after his hierarchical appeal was dismissed. He subsequently filed a complaint for psychological harassment with the Groupe de confiance. By email dated 25 February 2026, the head of department confirmed at the employee's request that his contract would not be renewed, citing a "lack of fit with the requirements of the post" and a "breakdown of trust".

By a filing posted on 27 March 2026, the employee appealed to the Administrative Chamber against that email. He sought the reclassification of his fixed-term contracts as an open-ended contract (CDI), or subsidiarily a finding of wrongful dismissal, with at least 24 months' salary as compensation and an award for non-material damage. He relied on the abusive succession of fixed-term contracts, arguing that the mission had become a permanent public-service task since the enactment of the LAPSA in 2021, alleged retaliatory dismissal, psychological harassment and — in his reply — unequal treatment.

2. Decision of the Court

The employee's appeal was declared inadmissible for lack of an appealable decision. His requests for investigative measures (hearing of witnesses, production of documents) were rejected by anticipatory assessment of the evidence. A fixed-term contract expires by operation of law at the end of its term (Art. 31(1) of the City of Geneva Staff Regulations), without any notice of termination. There is therefore no right to renewal of a fixed-term contract. The email recalling the expiry date neither creates, modifies nor extinguishes any right and is consequently not a decision within the meaning of Art. 4 of the Geneva Code of Administrative Procedure (LPA). It was moreover issued by the head of department, not by the Conseil administratif, which is the competent authority for personnel matters.

The four renewals and the nearly four-year duration exceeded the ordinary limits set out in Art. 29(2) and (3) of the Staff Regulations. The Chamber nevertheless found that the exceptional derogation in Art. 29(3), second sentence applied. It held that the emergency-housing scheme depends on fluctuating annual needs without any permanent funding, and that the Conseil administratif had adopted a policy of fixed-term contracts followed by progressive appointment to permanent posts. There was therefore neither an abuse of rights nor grounds for reclassification as an open-ended contract, since the four-year ceiling had not been reached (Art. 29(4)).

The disciplinary proceedings explained the non-renewal but were not its legal cause, and accordingly there was no retaliatory dismissal. The alleged harassment related to disciplinary proceedings that had been concluded and had become final. The complaint of unequal treatment, raised only in the reply, was time-barred and in any event unfounded. The appeal was thus dismissed on all grounds.

3. Commentary

The core reasoning follows established Geneva case law: the expiry of a fixed-term contract does not constitute a dismissal, there is no right to renewal, and a mere reminder of the expiry date is not an administrative decision. The employee had never challenged his contractual status despite the annual renewal letters and emails. The rejection of the unequal treatment argument, raised only in the reply, likewise accords with federal case law on late-raised complaints.

a) Inadmissibility disguised as a merits dismissal

The Chamber concludes that no appealable decision exists, yet it has examined in detail the substantive questions of abuse of rights, the exceptional character of the extension, reclassification as a permanent contract and alleged reprisals. Had reclassification been accepted, a refusal to continue the employment relationship would have constituted a dismissal, and a dismissal would have required a formal decision. The inadmissibility ruling is therefore in substance a disguised merits dismissal. Such a circular approach is understandable when the same factual finding governs both admissibility and the merits. Here, it leads to a harsher outcome for the appellant, who faces inadmissibility with no further avenue for review.

b) The email as a rejection of a request

The email could have been read as the rejection of a request. The employer had invited fixed-term employees to express their wish to continue or discontinue the employment relationship. The employee did so and then requested a formal statement of reasons. The reply set out grounds for non-renewal based on his conduct. It can be argued that this is equivalent to the rejection of a request seeking to create rights, and therefore constitutes a decision within the meaning of Art. 4(1)(c) LPA, at least for the purpose of reviewing compliance with the prohibitions on arbitrariness, bad faith and unequal treatment. The judgment dismisses this argument by falling back on the absence of a right to renewal — which is once again a merits question. The argument based on competence (the email was issued by the head of department) is weak: it amounts to saying that an employer can avoid all judicial oversight simply by refraining from issuing a formal decision. The judgment also fails to indicate how the employee could have obtained a reviewable decision.

c) Fragile application of Art. 29 of the Staff Regulations

The application of Art. 29 of the Staff Regulations is open to criticism. Art. 29(2) limits the number of renewals to two. The employee had four. The derogation in Art. 29(3), second sentence, relates on its face to the total duration (from three to four years), not to the number of renewals. The Chamber notes the excess but does not explain why the exception also covers Art. 29(2). Doubts also arise as to the "exceptional" nature and "particular circumstances" when the judgment itself describes a general policy of fixed-term contracts followed by permanent appointments applicable to all staff hired in 2022. The judgment likewise fails to verify that a formal decision of the Conseil administratif actually extended the contract beyond three years: the last contract was signed by the Mayor, and the Chamber simply relies on the strategy "as rightly noted by the City".

d) Conditions of Art. 28(1) of the Staff Regulations left unexamined

The conditions for lawful use of fixed-term contracts under Art. 28(1) of the Staff Regulations are not examined. A fixed-term contract is permitted only for a temporary, seasonal or experimental mission, or where external funding is not permanent. "Fluctuating" needs and the absence of a "permanent financial guarantee" do not correspond literally to these categories. The argument based on the LAPSA (permanent public-service task, shelter open 365 days a year) is not addressed. The employee's submission that the employer ended the relationship one month before the four-year ceiling — thereby avoiding automatic permanent appointment under Art. 29(4) — is also left without a response.

e) Questionable anticipatory assessment of evidence

The anticipatory assessment of evidence is also questionable. The Chamber refuses to order production of the anonymised list of fixed-term contracts converted to open-ended contracts and of the job descriptions, dismissing them as "irrelevant". Yet those documents would have allowed verification of the actual existence of the permanent appointment policy, the exceptional character of the extension and the question of equal treatment. By rejecting those items while accepting the City's assertions on those same points, the Chamber risks being criticised for an incomplete establishment of the facts and even a violation of the right to be heard — all the more so as Geneva administrative procedure is governed by the inquisitorial principle.

f) Reconciling warnings and res judicata

Recital 3.4 recalls that warnings are in principle not administrative decisions. Recitals 4.9 and 5, however, oppose the employee on the ground that the warning has become "final" in the absence of an appeal. The Chamber does not explain how to reconcile the two. An appeal is available under the Staff Regulations (Art. 104), which opens a review channel. The judgment should have said so, and this point is central to the reprisal complaint. To say that the disciplinary proceedings "explain" the non-renewal without constituting its "legal cause" is an artificial distinction: the alleged reason for non-renewal is precisely what is in issue in the retaliatory dismissal complaint.

g) Psychological harassment and alternative remedies

The alleged psychological harassment and breach of the employer's duty of care are complaints distinct from the disciplinary warning. A complaint with the Groupe de confiance is also pending. The Chamber dismisses them as "irrelevant" because they relate to a decision outside the scope of the dispute. This may be correct on admissibility grounds, but the judgment does not indicate whether those claims (non-material damage) could be pursued by another route.

1. Sachverhalt

a) Unzulässigkeit als verkleidete Sachentscheidung
